OFFICIAL RULES & REGULATIONS for “Frank’s Energy Girls Model Search” (the "Contest")
Please read the Contest Rules in their entirety before entering the Contest. Please do not enter the Contest unless you agree to these Rules. Participation in the Contest constitutes full and unconditional agreement and acceptance of these Contest Rules, which are final on all matters relating to the Contest.
Eligibility
This Contest is only open to individuals 21 years of age or older who are legal residents of the State of California. Employees (and those with whom they are domiciled) of Frank’s Energy Drink, Los Angeles Turf Club, Incorporated and their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies are not eligible to enter.
How to Enter: No purchase necessary. To enter the Contest, please follow these steps: Use your browser to go to Frank’s Energy contest page at: http://www.franksenergycontests.com Click on the link beneath the graphic header entitled "Enter Contest" and follow the instructions given to complete the entry form.
All Contest entrants will be pre-screened by a panel of Frank’s Energy Drink judges and the top entrants, up to a maximum of 50, will be selected to take part in the Countdown Round of the Contest.
If all Contest conditions are met, a Frank’s Energy Drink representative will contact the selected contest participants to make arrangements for taking part in the Countdown Round of the Contest. Countdown Round participants must arrange for their own transportation to the Contest location and are responsible for their own expenses, including but not limited to accommodations and transportation to travel to and from the Contest location and while participating in the Contest. In order to take part in the Contest, selected Contest participants must print out and sign a Declaration, Release and Waiver Form to be provided. Failure to sign and return the Declaration, Release and Waiver Form will disqualify the participant from taking part in the Contest.
The Countdown Round of the Contest will take place during the week of January 21, 2008 at a time and location to be announced. Contestants will be asked to perform the following tasks: 1) yodel (with fun and flair); 2) model a Frank’s Energy Girls lederhosen outfit (lederhosen will be supplied); and 3) answer questions about Frank’s Energy Drink. All Countdown Round contestants will take part in the Semi-Final Round on Saturday, January 26, 2008 at Santa Anita Park in Arcadia, California at a time to be announced at a later date. At the Semi-Final Round, the top 5 contestants, as determined by a panel of 3 celebrity judges, will then advance to the Final Round, to take place on the same day. The top five finalists, including the 1st place winner, the 2nd place winner, the 3rd place winner, the 4th place winner, and the 5th place winner will be chosen from among the 5 finalists and will be determined by the live audience in attendance at the Contest.
The Contest begins at or about 12:00 noon EST on December 20, 2007, (the "Contest Start Date") and closes at or about 5:00 p.m. EST on January 22, 2008 (the "Contest Closing Date").
By entering this Contest, you agree to be bound by the decisions of Frank’s Energy Drink, which are final with respect to all matters relating to the Contest. Frank’s Energy Drink, in its sole discretion, may disqualify any contestant who is found to have tampered in any way with the operation of the Contest.
Prizes: The prizes are as follows:
The prize winners will receive priority status for all Frank’s Energy Drink assignments within the California market in accordance with how they place in the contest (i.e., the first place winner will receive priority status for all assignments; the second place winner will be next in terms of receiving priority status, etc.) at the discretion of Frank’s Energy Drink.
General Rules: Entrants will be asked to provide their name, email address, telephone number, city, address and zip code and answer additional informational questions. Entrants will also be asked to provide a full-length photo of them.
In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the authorized holder of the e-mail account and may be disqualified at the discretion of Frank’s Energy Drink. The authorized account holder is the individual who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address.
Entrants agree to the use of their names, addresses (city/town) and likenesses (e.g. photo and video) for promotional purposes for this and similar promotions, for publication, and for marketing purposes by Frank’s Energy Drink, without further compensation or notification. All entries become the sole property of Frank’s Energy Drink (“Sponsor”).
This Contest is void where prohibited by law and is subject to all applicable federal, state and local laws. All incidental costs and expenses not specifically referred to herein, including (without limitation) taxes and transportation costs to and from Frank’s Energy Drink assignments, shall be the sole responsibility of the prize winners.
All potential winners are subject to verification by Sponsor, whose decisions are final. Sponsor shall solely determine any form of verification. An entrant is not a winner of any prize unless and until the entrant's eligibility has been verified and the entrant has been notified that verification is complete. Sponsor will not accept screen shots, affidavits or other evidence of winning in lieu of its validation process. Any entry that occurs after the system has failed for any reason may be deemed a defective entry and void.
By entering the Contest, entrants agree to hold harmless Frank’s Energy Drink, and their respective subsidiaries, affiliates, directors, officers, governors, agents and advertising and promotional agencies (collectively, the "Released Parties") against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) entrant's participation in the Contest; (ii) the receipt or use of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.
Before being awarded a Prize, potential winners must sign Frank’s Energy Drink standard form of Declaration, Release and Waiver form, releasing the Released Parties from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.
Prize must be accepted as awarded and cannot be exchanged for cash or otherwise. No telephone contact or correspondence will be entered into except with potential prize winners.
Frank’s Energy Drink reserves the right to substitute prizes of equal or greater value and/or to terminate, modify or withdraw this Contest, in whole or in part, at any time, without prior notice for any reason including, but not limited to, the delay or cancellation of the Contest for which the prize is awarded. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise.
Frank’s Energy Drink does not assume any responsibility for tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in damage or malfunction the computer or the failure of Frank’s Energy Drink to process any entry and otherwise award any prize. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should an attempt be made, Frank’s Energy Drink reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

| Fourth Place: | A two-month modeling contract with Frank’s Energy Drink with a potential maximum value* of up to $8,000. |
| Fifth Place: | A one-month modeling contract with Frank’s Energy Drink with a potential maximum value* of up to $5,000. |
| *The actual prize value is not guaranteed and winners are only eligible for Frank’s Energy modeling opportunities which may arise and may collectively have an aggregate value as stated above, depending on the nature and extent of the promotional campaign. |
